§ 13-34. Consent or franchise fee.

  • The annual fee for use of streets or public places authorized by a consent agreement or franchise agreement shall be set by the ordinance approving the agreement. Except for telecommunications companies, such fees shall be based on gross revenues derived from activities in the municipality, the length of lines installed in the streets and public places, or other formula deemed appropriate by council. No such consent fee or franchise fee shall be construed to be in lieu of a business license tax based on gross revenue unless specifically provided by council. Pursuant to South Carolina Code, section 58-9-2230, the annual fee for telecommunications companies for use of streets or public places authorized by a consent agreement or franchise agreement shall be five hundred dollars ($500.00) for each such agreement.
